According to the provisions of Article 17, paragraph 2 of the Consumer Protection Law, the consumer is not entitled to replace or retrieve the commodity in the event that the commodity carton is opened or the commodity is used, as is evident in the following cases:
A- If the nature of the commodity, its characteristics, or the way it is packaged or wrapped, precludes or changes its replacement or return, or if it is impossible to return it to the condition it was in at the time of the contract.
B- If it is not in the same condition as it was at the time of sale due to a reason attributed to the consumer.
• As an exception to the text of this article, the product shall be replaced with a refund of the price difference between the models, if any, or the item shall be returned to the customer and its value shall be refunded, but after deducting (5%) packaging from the total value of the item.
• In addition to deducting shipping costs in accordance with Article (40), paragraphs (1 and 2) of the Consumer Protection Law (the supplier is obligated to refund the amount paid to the customer in the same method of payment, and the consumer bears the costs of shipping and returning the product).
